How to Keep Your Kids Safe While Dealing With Custody Issues
When your child is born, you don't normal foresee needing to seek child custody. Unfortunately it is happening more often lately, that the children become caught in the middle of their parents battle. In most cases, each parent just desires the most time with their kids, but their feelings for each other drive a need in them to "beat" or "win" the battle against the other. However, there are a few cases where the battle is for less than worthy reasons. Be sure to keep these things at heart, whatever your reasoning for seeking help with your child custody case.
Make sure you have a competent lawyer. When it comes to custody battles, you need someone who has lots of experience with Family Court. A "sanctioned" lawyer isn't necessarily your best move for this type of case. You want someone who specializes in family matters and custody cases. These lawyers are far more familiar with the way Family Court works (which is a lot different than Criminal or Civil Court). You should pursue an attorney who has experience working with children and is aware of what judges look for when figuring out what is best for the children. You will be much better off if you try to get someone who has a great knowledge of how to work with Child and Family Services as well because they will have had experiences working with the Department of Child and Family Services and making them feel mirthful if they get a call to help you with mediaton. Have you thought about joint custody? There are a number of ways to arrange for joint custody. Some arrangements are set up so that the child or children spend half of their time with mom and the other half with dad. Other arrangements see one parent taking over the majority of the parenting responsibilities while the other parent only sees the child periodically. Unless your kids are in immediate danger from their other parent, a judge will want you to at least think about joint custody. You need to prepare yourself to consider all possibilities when considering child custody help.
Be mindful that child custody cases are very unpredictable. They are a lot more uncertain than divorce and various civil cases. When it comes to the shelter and safety of children, courts do not mess around. This is why there is an entirely separate court system for cases that deal with child and family matters. You aren't battling over some furniture or possessions here. You are arguing about your children and you need to plead for them.
Nobody likes to admit that they need assistance with child custody. When a child is born the parents typically are not foreseeing a day when the law has to step in to help them determine what is best for the child. The most important thing to keep in mind when managing custody issues is that it is not your needs that are trying to be met, but the needs of your children. Tread carefully and make sure you know the laws in your state. You don't want to be surprised!
